Businesses
If using the Services on behalf of a company or organization, you represent that you have authority to act on its behalf, and that the entity accepts these Terms. You are responsible for all activity under your account.

2. Use of the Services
2.1 Account

You may be required to create an account. You promise to provide accurate, complete, and updated registration information. You may not share your account with others and are responsible for all activity under your account.

2.2 Health and Meal Data

The Services involve collecting personal health and dietary information to provide personalized nutritional analysis and recommendations. You are responsible for the accuracy of the data you provide.

2.3 AI-Generated Recommendations

Our AI analyzes your meals and nutrient intake to generate recommendations. AI outputs may be inaccurate or require human discretion. You are solely responsible for decisions made based on AI recommendations.

3. Permissions and Restrictions

You may use the Services as permitted by this Agreement and applicable law. You agree not to:

  • Violate any law or third-party rights

  • Provide harmful, fraudulent, or misleading information

  • Attempt to access other users’ accounts or data

  • Interfere with system security or reverse engineer the platform

  • Use the Services to develop competing nutrition models

Violation of these rules may result in suspension or termination of your account.

4. Payments and Subscriptions

Paid Services
Some Services may require payment. Payment terms presented during signup are part of this Agreement.

Recurring Billing & Auto-Renewal
Subscriptions automatically renew unless canceled. You are responsible for all recurring charges until cancellation is processed.

Refund Policy
All sales are final. No refunds are offered for subscriptions or credits once payment is processed.

Free Trials and Promotions
Free trials must be used within the specified period. You must cancel before the trial ends to avoid charges.

5. Third-Party Services

Certain features may rely on third-party services (e.g., analytics or cloud providers). We are not responsible for the content, accuracy, or practices of third parties.

6. Account Suspension and Termination

By You: You may stop using or delete your account at any time.
By Us: We may suspend or terminate access at our discretion for violations of these Terms. Termination may result in deletion of your health and meal data.

7. Intellectual Property

You retain ownership of the data and content you provide. By using the Services, you grant us a license to process, analyze, and display your data for the purpose of providing the Services.

8. Disclaimer of Warranties

The Services are provided “as is” and “as available.” We disclaim all warranties, including merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee uninterrupted or error-free service.

9. Limitation of Liability

To the fullest extent permitted by law, Fobalanz is not liable for indirect, incidental, or consequential damages, including loss of data or revenue. Total liability will not exceed the greater of (a) total fees paid in the past 12 months or (b) $100 USD.

10. Indemnification

You agree to indemnify and hold harmless Fobalanz and its affiliates from claims arising from your use of the Services, violation of these Terms, or infringement of third-party rights.

11. Governing Law and Dispute Resolution

These Terms are governed by the laws of your country or region. Disputes will first attempt informal resolution. Failing that, disputes may be resolved by arbitration or other agreed dispute resolution mechanisms. Class action waivers may apply.

12. Changes to Terms

We may update these Terms from time to time. Continued use of the Services constitutes acceptance of changes.

14. AI Processing & Data Usage

By using the Services, you acknowledge that your health and meal data is processed by AI systems to provide nutrient analysis and personalized meal recommendations. Data may be temporarily stored to support processing and service delivery. You retain ownership of all data you provide.
